1. Overview

We try to describe and photograph our products accurately, but colours, sizes and details may vary slightly from what you see on screen. All prices are shown in the currency indicated at checkout and, unless stated otherwise, exclude shipping and any applicable taxes, which are added before you pay.

We may change prices, product details or availability at any time without notice. If we discover a pricing or description error on an item you have ordered, we will contact you and give you the choice of confirming the order at the correct price or cancelling it for a full refund.

4. Orders and payment

Your order is an offer to buy. We accept it, and a contract is formed, when we send you a confirmation email. We may refuse or cancel any order, for example if an item is out of stock, if we suspect fraud, or if the order breaches these Terms. If we cancel an order you have already paid for, we will refund you in full.

Payment is taken at the time of order using the methods shown at checkout. You confirm that you are authorised to use the payment method you provide. We may run fraud checks before accepting an order and may ask you for additional verification.

5. Shipping and delivery

Delivery times shown on the Site are estimates and are not guaranteed. Full details of processing times, shipping costs and what happens if a package is lost or damaged are in our Shipping Policy, which forms part of these Terms.

Risk of loss passes to you when the order is delivered to the address you gave us. Title passes to you once we have received payment in full.

6. Returns and refunds

Our Refund Policy explains when you can return an item, how to do it and how refunds are processed. It forms part of these Terms.

7. Discount codes and promotions

Discount codes and promotions are subject to the conditions stated when they are offered, cannot usually be combined, have no cash value and may be withdrawn at any time. We may cancel orders that misuse a code, including codes that were not intended for you.

8. Accounts

If you create an account, you are responsible for keeping your password confidential and for everything that happens under your account. Tell us immediately if you think your account has been accessed without permission. We may suspend or close accounts that breach these Terms.

9. Intellectual property

Everything on the Site, including text, images, logos, product designs and software, belongs to [Store name] or our licensors and is protected by copyright and trademark law. You may not copy, reproduce or use any of it for commercial purposes without our written permission.

10. Reviews and user content

The clauses an ecommerce store actually needs

Terms and conditions set expectations before a dispute happens, which is what makes them worth having even for a one-person store. At minimum, cover pricing and payment (prices in USD, when a card is charged, what happens if a price is listed wrong), shipping (that it is governed by your separate shipping policy), and returns (also governed by your refund policy, referenced not repeated).

If you sell digital products, add a clause on delivery method and on the fact that digital goods are generally non-refundable once accessed, subject to your refund policy. If you offer subscriptions, state the billing cycle, how to cancel, and what happens to access after cancellation. If you take pre-orders, state the estimated ship window and that it can change.

Limitation of liability and governing law

A limitation of liability clause caps what a customer can claim from you, typically to the amount they paid, and excludes indirect or consequential damages. It will not protect you from every claim, but it is standard practice and insurers and payment processors expect to see one.

A governing law clause states which state or country's law applies if there is a dispute, usually wherever your business is registered. Pair it with where disputes are resolved, such as small claims court in that jurisdiction, so both sides know the process upfront.

Cross-referencing your other policies

Terms and conditions should point to, not duplicate, your refund policy and shipping policy. Keep each policy in one place and link between them, so an update to shipping cost or a return window only has to happen once.

They are generally the same document under two names. Terms and conditions is more common for stores selling physical goods; terms of service is more common for software and digital products. Either name works.
Do I need separate terms if I sell subscriptions?
You do not need a separate document, but your terms should include a subscription section covering billing cycle, cancellation and what happens to access afterward.
Should returns be in the terms or a separate policy?
Both work. Most stores keep a short reference in the terms (returns are governed by our refund policy) and the detail in a dedicated refund policy page, which is easier to update.
Do terms and conditions need to be accepted at checkout?
It is standard practice and reduces disputes to add a checkbox or a statement at checkout that placing an order means the customer agrees to your terms.
Can I use the same terms for digital and physical products?
Yes, one document can cover both if you write a separate clause for each, since delivery, refund eligibility and liability differ between the two.
